INTRODUCTION

These Terms and Conditions constitute a legally binding agreement between you and Xcursions regarding your access to and use of the Xcursions website, mobile application, and all related platforms and services. By accessing or using Xcursions, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must discontinue using the platform immediately. Xcursions operates as a digital travel marketplace and financial services facilitator that enables users to discover, book, and manage travel-related products, as well as access certain digital financial tools. Xcursions is not an airline, hotel, tour operator, insurance company, financial institution, or visa authority. We provide an online platform that aggregates information, processes bookings, and enables transactions between users and third-party service providers.

ELIGIBILITY AND ACCOUNT CREATION

Use of the Xcursions platform is limited to individuals who are at least eighteen years of age and who have the legal capacity to enter into binding contracts. To access certain features, you must create an account using accurate and complete information, including your name, email address, phone number, and any additional verification details required by Xcursions or applicable regulations. Xcursions may require you to undergo identity verification procedures, including the submission of government-issued identification, selfies, or additional documentation for compliance or security purposes. You are responsible for safeguarding your login credentials and for any activity conducted through your account. Xcursions reserves the right to suspend or terminate accounts that appear to be involved in fraudulent, abusive, or suspicious activity, or that violate any provisions of these Terms.

ROLE OF XCURSIONS IN SERVICE DELIVERY

Xcursions operates strictly as an intermediary and technology platform that facilitates bookings and payments. All travel services listed on the platform, including flights, hotel stays, accommodation, airport transfers, tours, travel packages, insurance, eSIM services, and visa services, are provided by independent third-party suppliers. All financial services, including wallet operations, USD stablecoin storage, and virtual card issuance, are facilitated through licensed third-party partners. Xcursions does not control, manage, or guarantee any supplier's performance, availability, quality, safety, legality, or compliance. By using Xcursions, you acknowledge that Xcursions is not responsible for any representations, acts, errors, delays, service failures, omissions, or negligence of third-party suppliers. Your contractual relationship for travel and financial services is primarily with the supplier that fulfills the service. Xcursions' responsibility is limited to transmitting booking information, processing payments where applicable, and offering user support where possible.

BOOKING TERMS FOR FLIGHTS, HOTELS, TOURS, AND OTHER TRAVEL SERVICES

When you make a booking through Xcursions, you authorize us to process your reservation with the relevant supplier. Availability, pricing, and service descriptions are provided to us by third-party systems, and may change at any time before final confirmation. Airline operations, such as schedule changes, delays, baggage allowances, seat assignments, and cancellation policies, are governed exclusively by the airline. Hotels and accommodation providers determine room availability, amenities, check-in rules, security deposits, incidental charges, and service delivery standards. Tour operators, transportation partners, and activity providers manage itineraries, safety procedures, operational adjustments, and cancellation rules. Xcursions may modify an itinerary or booking when necessary due to weather conditions, supplier changes, operational disruptions, or safety concerns, and will notify you promptly. For eSIMs, Xcursions does not guarantee signal strength, network coverage, speed, or uninterrupted service, as these factors depend on third-party network providers. For visa services, Xcursions does not influence embassy decisions or processing times; visa approval or refusal remains solely at the discretion of the issuing authority. Insurance products are administered entirely by licensed insurers, and all claims must be directed to the insurer in accordance with their terms.

PAYMENT TERMS AND PRICING

All pricing displayed on Xcursions reflects the information received from suppliers and may fluctuate due to availability, market dynamics, currency movements, or supplier policy changes. A booking is not confirmed until payment is successfully processed and a confirmation receipt is issued. Xcursions may charge service fees or administrative fees in addition to supplier charges. You authorize Xcursions to process payments using your selected method, including cards, bank transfers, or wallet balance. If a payment is rejected or reversed, Xcursions may cancel the associated booking without liability.

CANCELLATIONS, CHANGES, AND REFUNDS

Cancellation and refund rights vary depending on the supplier's policies and the specific service booked. Many travel services, including flights, eSIMs, and visa services, may be strictly non-refundable. Where a refund is permitted, Xcursions will process it in line with the supplier's terms and may deduct administrative charges where applicable. For group trips organized by Xcursions, cancellation rules are clearly communicated within the trip documentation. In general, cancellations more than ninety days before departure may qualify for a refund less the deposit; cancellations within ninety days may qualify for credit toward future travel; cancellations within sixty days may qualify for reduced credit; and cancellations within thirty days typically result in forfeiture of the full booking value. Xcursions is not responsible for additional costs resulting from airline rescheduling, missed connections, changes in visa processing times, natural disasters, or force majeure events. If Xcursions cancels a trip due to safety concerns, operational reasons, or government restrictions, affected users will receive a refund or travel credit, excluding personal preparation expenses such as flights, visas, or equipment.

WALLET SERVICES (NGN AND USD STABLECOIN)

Xcursions provides users with a digital wallet that allows the storage and use of Nigerian Naira and USD-denominated stablecoin values. Funds stored in the wallet do not represent bank deposits and do not earn interest. The USD balance is a digital equivalent held through licensed third-party custodial partners, and not a product issued by Xcursions. Wallet balances may be used to pay for travel services, load virtual cards, and conduct supported in-app transactions. Users must not use the wallet for illegal activities, including money laundering, terrorism financing, unauthorized transfers, gambling, or fraudulent transactions. Xcursions may suspend wallet access, freeze funds, or report activity to regulators where required by Nigerian law. You acknowledge that wallet transactions may be irreversible, and Xcursions is not liable for losses resulting from user error, compromised accounts, or external attacks that occur due to negligence outside Xcursions' systems.

VIRTUAL CARD SERVICES

Virtual cards available on Xcursions are issued and managed by licensed third-party financial institutions. Xcursions itself is not a card issuer and does not control card limits, fees, dispute timelines, or chargeback outcomes. When you activate or use a virtual card, you agree to comply with the issuer's cardholder agreement. Unauthorized transactions must be reported promptly. Xcursions is not responsible for merchant acceptance, refunds on card payments, or failures resulting from network or issuer outages.

BILL PAYMENTS

Xcursions enables users to purchase airtime, data, and other bill-related services through linked payment systems. All bill payments are executed using information provided by the user. Xcursions is not liable for losses incurred due to incorrect numbers, delayed delivery by network providers, or issues arising from telecom operators or utility companies.

AI-GENERATED CONTENT

Xcursions may provide automated recommendations, travel suggestions, or assistance through AI-powered features. While we strive to ensure helpful and accurate information, AI outputs may occasionally contain errors, outdated content, or misinterpretations. AI responses should not be treated as legal, immigration, or financial advice. You agree that Xcursions bears no liability for decisions or actions taken based on AI-generated content.

USER CONDUCT

You agree to use the platform responsibly and lawfully. You may not engage in fraudulent activities, create multiple accounts to exploit promotions, interfere with system operations, attempt unauthorized access, impersonate others, abuse customer support agents, manipulate pricing, or violate supplier rules. Xcursions reserves the right to suspend or terminate accounts and take legal action where necessary.

INTELLECTUAL PROPERTY

All content on the Xcursions platform, including trademarks, logos, text, images, user interface elements, software, and media, is protected by intellectual property laws and remains the exclusive property of Xcursions or its licensors. You may not reproduce, modify, distribute, reverse-engineer, or commercially exploit any part of the platform without written authorization.

LIMITATION OF LIABILITY

To the fullest extent permitted under Nigerian law, Xcursions shall not be liable for indirect, incidental, punitive, special, or consequential damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the platform or third-party services. Xcursions is not liable for failures, mistakes, delays, cancellations, strikes, accidents, natural disasters, immigration decisions, illness, or any event outside our direct control. Xcursions' maximum liability to you shall be limited strictly to the amount paid for the service in question.

INDEMNIFICATION

You agree to indemnify and hold harmless Xcursions, its employees, partners, and affiliates from all claims, liabilities, damages, legal costs, and expenses arising from your breach of these Terms, violation of laws, misuse of the platform, or disputes with third-party suppliers.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed exclusively by the laws of the Federal Republic of Nigeria. Any disputes arising between you and Xcursions shall be resolved through negotiation where possible, failing which the matter shall be submitted to the appropriate courts in Nigeria.

AMENDMENTS

Xcursions reserves the right to amend these Terms at any time. Updated Terms will be published on the platform, and continued use after such updates constitutes acceptance of the revised Terms.
